If you are a homeowner who is committed to selling your home yourself, welcome! Razorback By Owner is committed to the concept of a pure "For Sale by Owner" (FSBO) website and business in Northwest Arkansas. In order for us to assist you in marketing your property you must agree to all the terms and conditions of Razorback By Owner.
- Your listing with Razorback By Owner is Exclusive.
In order for you to list with us you must agree to not advertise your property for sale with a Realtor or Broker while listing with us. We must do this in order to maintain the quality of information that we have on our website. Buyers must be confident that they are truly buying directly from the owner of the property. Sellers can advertise in any other form of medium they wish while listing with us. We encourage newspaper ads and will contribute up to $30.00 if you include our website, www.arestatebyowner.com in your ad. Please see number 13 for more information.
- We represent neither the buyer, nor the seller. We simply provide an advertising forum for FSBO home sellers and a data base list of FSBO homes for the potential buyers. All binding contract, sales agreements, and all legal aspects in regards to the sale of each property are between the seller and the buyer. We are not realtors and aside from our initial advertisement listing fee we do not receive any type of commission from the Seller. We receive absolutely nothing from the Buyer.
- One Property Listing Service. Razorback By Owner Listing Service is for one property only and may not be transferred to another property.
- Listing Fees. The advertisement service fee is non-refundable and non-transferable. Please see the Services and Pricing for current listing prices, available accessories and accessories prices.
- Accuracy of Information for Listings. The home seller is responsible for the accuracy of their listing. Razorback By Owner has no responsibility for the accuracy of the sellers listing. Those knowingly misrepresenting their property will be asked by Razorback By Owner to correct the inaccuracy. Refusal to do so may result in termination of your listing.
- Ownership of Signs and Sign Accessories. Razorback By Owner owns the signs and sign accessories. The home seller leases the signs and sign accessories.
***All Addition Signs and Sign Accessories must be reserved at the time of the new seller listing registration. They will be delivered at the same time the Basic Listing-Large Sign is delivered. If the seller reserves addition signs or sign accessories after the Basic Listing-Large Sign has already been delivered and installed the seller will agree to pay an additional $20.00 delivery fee.
***Note: All signs and sign accessories are owned by Razorback By Owner. The Home Seller is only leasing them. All signs and sign accessories must be made available for pick up after the term of the Seller’s listing. Sellers are responsible for the signs that they lease from Razorback By Owner. Non-returned, returned damaged and stolen/missing signs are responsibilities of the home seller. The seller will be responsible for all fees associated with each item.
***Good Condition/Non-Damage – “No damage to any item other than normal wear and tear due to wind/weather and Razorback By Owner will not have to make any repairs or replace them.”
- Signs and Sign Accessories. Signs are delivered/installed in the selected areas only. Outside Sign Delivery Area. If the sellers’ property is outside our delivery area we will send/mail the sellers the sign and post and the sellers are responsible for installing the sign themselves. Receipt of signs from mailing of signs may take up to 2 weeks. Sign products may be mailed to the home seller for use outside our delivery area at the home sellers mailing cost. The seller is also responsible for mailing the sign products back to Razorback By Owner, at the home sellers cost. See Sign Delivery Area to determine if your location is in our delivery area.
- Large Sign Installment/Safe Location. Mark a location, free of underground utilities, where you want us to place your yard sign. If you are reserving more than one large sign mark that many locations. Call the Arkansas One Call to confirm clearance of all underground utilities. We place your yard sign where you mark, so the home owner is responsible for any or all utility damages. If no location is marked Razorback By Owner representatives will use their judgment in placement of the signs.
- Sign Delivery/Installation Area. If
the seller’s property is within our Sign
Delivery Area your sign will be delivered/installed within 5-7 business
days after your property is registered/listed with Razorback By Owner.
- Permission to Come on to Property. All sellers must agree and allow Razorback By Owner representatives to come on to their property for the purpose of delivering, installing, uninstalling, picking up signs and for any other purposes regarding services Razorback By Owner provides.
- Other Non-Razorback By Owner Signs. Home sellers agree to not allow buyer's real estate agents to place their realtor® yard signs in your yard at any time while listed on Razorback By Owner.
- No Refunds. Since we incur nearly all of our expenses in the first few days of listing a new property we cannot offer refunds. There will be no refunds for any unused portion of listing term time. For example, if your property sells in just one month after listing and you do not use up the full six months you do not get credited for the remaining five months.
- We will contribute $10.00 for each ad you place in the newspaper that also includes the www.arestatebyowner.com website address. We will pay for up to 3 ads of different dates. (We will reimburse you one time when you send in all your newspaper ads with the name of the paper and date showing-so, if you've placed three, meeting the criteria, we would send you a check for $30. Not valid with other advertising offers or discounts.)

If there is misrepresented information on a property and it is brought to
our attention, those sellers that are knowingly misrepresenting their property,
whether intentional or unintentional will be asked to correct the information.
If corrections are not made Razorback By Owner will terminate the seller’s
listing with no refund.
Razorback By Owner in not involved in any aspect of the actual sale or purchase
of a property. Razorback By Owner provides sample real estate forms that
will accommodate most real estate transactions, but it is up to the sellers
and buyers to confirm that these forms will be sufficient for their individual
real estate transaction needs. Razorback By Owner has no legal responsibility
or obligations to any law suites between buyers and seller in regards to
the purchase or sale of any property.
